Job Description Kite, a Gilead Company, is a biopharmaceutical company focused on the development and commercialization of novel cancer immunotherapy products designed to harness the power of a patient's own immune system to selectively target and kill cancer cells.
Our core technology involves the genetic engineering of T cells, or white blood cells, to express either chimeric antigen receptors (CARs) or T cell receptors (TCRs) for the treatment of advanced solid and hematological malignancies.
Position Overview: The legal department at Kite is seeking an Associate General Counsel / Executive Director to join its U.
S.
Commercial Legal team.
This position is based at Kite’s corporate headquarters in Santa Monica, CA, and will report to Kite’s Head of Legal.
This role will support all commercial legal and healthcare compliance aspects of Kite’s cell therapy business in the U.
S.
, including support for Commercial, Medical Affairs, Regulatory, Market Access, and Government / Public Affairs.
This role will have the opportunity to participate in strategic decision making with a broad range of functional groups within the company.
This is an exciting opportunity for an experienced attorney with strong leadership skills and an ability to provide strategic advice and counsel to senior executives in a rapidly growing business focused on the exciting new field of cell therapy.
Collaboration with Kite’s ex-U.
S.
business will also be required, and this role will liaise with the legal teams in Europe.
Because Kite is part of Gilead Sciences, Inc.
regular contact with the Gilead Legal team at Gilead headquarters in Foster City, CA, as well as at various international Gilead locations, will be required.
Position Responsibilities: Provide advice and counsel to Commercial, Medical, Regulatory, and other relevant functions on strategies, programs, policies, practices and initiatives with respect to compliance with relevant healthcare laws, guidance documents or opinions, and industry codes (FDCA, FDA guidance documents, Fraud and Abuse laws, Anti-kickback Statute, federal and state transparency laws, OIG Advisory Opinions, etc.
) Provide legal advice and guidance on advertising, promotional and educational materials submitted for review.
Review and provide legal guidance on financial and other interactions with healthcare professionals, patients, or others in a position to influence healthcare decisions (e.
g.
, payers, advocacy groups, distributors, etc.
) to ensure compliance with applicable laws and regulations.
Provide guidance and work collaboratively with internal business clients on policies and procedures to ensure compliance with statutory and regulatory drug pricing and price reporting obligations under Medicaid, Medicare and the 340B program.
Collaborate with internal business clients and colleagues across multiple line functions, and with external counsel as needed to ensure various programs meet legal and regulatory.
Support product launches.
Provide guidance regarding reimbursement and coverage matters.
Provide legal support for a range of activities associated with implementing patient assistance and support programs.
Draft, review and negotiate various agreements in support of all the foregoing.
Basic Qualifications: J.
D.
degree from a nationally recognized law school.
Admitted to practice in the U.
S.
, preferably in California, or ability to register in California as in-house counsel.
At least 12+ years as health law, life sciences or pharmaceutical compliance counsel either at a law firm, company and/or relevant government (e.
g.
, FDA) agency.
Preferred Qualifications: In-depth experience with the biotech or pharmaceutical industries, including business operations and regulatory framework.
Experience drafting, reviewing, and negotiating a wide variety of commercial agreements.
Strong analytical and interpersonal / communication skills.
High degree of professional ethics and integrity.
Self-motivated with a strong sense of ownership in areas of responsibility.
Ability to work in a matrixed organization.
Significant prior experience in oncology or with cell therapy.
Significant prior experience with market access, coverage and reimbursement, product pricing, patient support programs, and interactions with and payers and managed care customers.
